These terms apply to this website, to the free LocalForm plugin, and to a LocalForm Pro licence. By using the website or the software, you agree to them. If you are buying as a consumer in the EU, nothing here takes away the rights your national law gives you.

"We", "us" and "our" mean XeWeb. "You" means the person or organisation using the website or the software.

3. Using this website

The content of localform.dev and docs.localform.dev - text, screenshots, the logo and the documentation - belongs to us and is protected by copyright. You may read it, link to it, and quote it with attribution. You may not republish it wholesale or present it as your own. The LocalForm name and logo are our marks; do not use them in a way that suggests we endorse or supply your product.

We do our best to keep the website accurate and available, but we do not promise either. Documentation describes the software as it is intended to work, not as a contractual specification.

4. The free plugin

LocalForm is free software licensed under the GNU General Public License, version 2 or later. That licence, and not this section, sets out what you may do with the code: use it for anything, study it, modify it, and redistribute it under the same licence.

The GPL provides the plugin as is, with no warranty. There is no licence key, no account, no trial period and no limit on forms or submissions, and using the free plugin creates no contract between us beyond the GPL itself.

5. What a Pro licence gives you

The code in LocalForm Pro is also licensed under GPL-2.0-or-later. What you pay for is the service around it, for as long as your subscription is active:

You may move a licence between sites: deactivate it on the old site under LocalForm → Account before tearing that site down, otherwise the seat stays used up. A staging or development copy generally counts as one of your sites.

You must not resell or publish your licence key, share it outside your organisation, or work around the licence check. Doing so lets us suspend the licence without refund.

If a licence expires, is deactivated, or was never activated, Pro switches its features off but never touches your data: everything you have created stays stored and comes back when the licence is active again. Forms keep working; Pro-only behaviour simply stops applying. You also stop receiving updates, which is the main practical reason to renew.

6. Orders, prices and payment

Pro is sold through Freemius, which acts as the merchant of record. Your contract of sale for the licence fee is therefore with Freemius, and their checkout terms apply to the payment itself; these terms govern the licence and the software.

Prices are shown at checkout in the currency offered there. VAT and any other applicable tax is calculated and charged by Freemius on the basis of the details you enter. Your invoice is issued by Freemius and is available from LocalForm → Account in your WordPress admin.

A contract comes into being when Freemius confirms your order and the payment succeeds. Access to the download and the licence key follows immediately.

7. Renewals and cancellation

Licences are subscriptions and renew automatically at the end of each term at the rate shown at checkout, unless you cancel first. You can cancel at any time from LocalForm → Account or by emailing us. Cancelling stops the next renewal; your licence keeps working until the end of the term you already paid for.

If a renewal payment fails, the licence lapses and Pro's features switch off, with the consequences described in section 5.

8. Withdrawal and refunds

Refunds are handled by Freemius under the refund policy shown at checkout, and requests can also be sent to us at tim@xeweb.be. If the software does not do what we say it does and we cannot fix it for you, we will refund you.

Consumers in the EU normally have 14 days to withdraw from a distance contract. Because a licence is digital content delivered immediately, that right is lost once delivery has started with your express consent and your acknowledgement that you lose it - which is what the checkout asks you to confirm. This does not affect your statutory rights if the product turns out to be faulty or not as described.

9. Support

Support for Pro is provided by email at tim@xeweb.be while your licence is active. We aim to reply within a few business days; we do not offer a guaranteed response time or uptime commitment, because the software runs on your server, not ours.

Support covers the plugin: installing it, configuring it, and bugs. It does not cover custom development, theme or third-party plugin conflicts we cannot reproduce, server administration, or writing your forms for you. Free plugin users are welcome to report bugs, but priority goes to Pro licence holders.

10. Your responsibilities

The software runs on your own site, under your control. You are responsible for:

You must not use the software to collect data unlawfully, to send unsolicited mail, or in any way that breaks the law where you or your visitors are.

11. Data protection

Form responses stay in your own database and are never sent to us. For the forms you publish, you are the data controller and we are not a processor of that data - we have no access to it. Our privacy statement explains what we do process: website request data, correspondence, and the customer and licence data we receive from Freemius.

12. Third-party services

Some things depend on services we do not run: Freemius for checkout, licensing and updates; WordPress.org for the free plugin's distribution; whichever AI assistant you connect over MCP; and whatever endpoint receives your webhooks. Their own terms apply to them, and we are not liable for their availability or behaviour.

13. Changes to the product

We keep developing LocalForm, so features change. We will not remove a significant Pro feature during a paid term without offering you a comparable replacement or a pro-rata refund for the remainder of the term. Minimum WordPress and PHP versions may rise in new releases; the version you already have keeps working.

14. Warranties

The software is provided as is, without warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. We do not warrant that it will be free of bugs, or that it will work with every theme, plugin, host or configuration.

If you are a consumer, your statutory guarantees under Belgian and EU law apply regardless of this section, and nothing here limits them.

15. Liability

To the extent the law allows, our total liability arising out of or in connection with the software or these terms is limited to the amount you paid us for the licence in the twelve months before the event that caused the loss.

We are not liable for indirect or consequential loss, lost profit, lost business, lost data or the cost of restoring it - which is why you should take your own backups.

Nothing in these terms excludes or limits our liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be excluded. Again, consumers' statutory rights are unaffected.

16. Term and termination

These terms apply for as long as you use the website or the software. A Pro licence runs for its subscription term and ends when it lapses or is cancelled. We may terminate a licence, without refund, if you breach section 5 or section 10 in a serious way. On termination you keep your data and your forms; you lose updates, support and Pro's features.

17. Changes to these terms

We may update these terms as the product and the law change. The date at the top shows the current version. Changes that materially affect an existing licence take effect at your next renewal, and we will tell you by email before then.

18. Governing law and disputes

Belgian law governs these terms. Disputes go to the courts of the judicial district of Antwerp, except that a consumer may always bring proceedings in, and rely on the mandatory law of, the country where they live.

Please email us first - almost everything gets sorted out that way. Consumers in Belgium may also turn to the Consumer Mediation Service (consumerombudsman.be).
